Abstract

In the early modern period, familial relationships of dependency were regulated by law. For children, these subordinate relationships were governed by the application of patria potestas, which granted extensive powers to the head of the household over his offspring. Legislation, as applied in the territories of Castile, also established various legal frameworks through which sons could exit or be freed from paternal power. This research will present said legislation and emphasize one of the procedures: emancipation agreed upon, at least in theory, by mutual consent between father and son.
